November 2016 – Environmental Compliance Journal

The Water Act 2014 (Commencement No. 7 and Transitional Provisions) Order 2016 sets out provisions of the 2014 Act that came into force on 1st November 2016. The act consists of six parts with some of the more pertinent ones including Part 1, Water Industry, where the amendments introduce provisions to permit businesses, charities, and public sector customers to change their water and sewage supplier, regardless of their usage. Also Part 3, Environmental Regulation, establishes the provisions to permit the Secretary of State and the Welsh Ministers to make environmental regulations. These relate to water abstraction and impoundment licences, flood defence consents and requirements for fish passes and screens. The goal is to consolidate the different requirements into the environmental permitting regime.
