Exiting the EU, means this month there are more environmental legislation updates than usual. All amends will only take place on the day of exit. There will be changes in legislative wording to fit in with domestic UK legislation.  Most changes will be minor. The laws which will be affected are the following:

The Air Quality Standards (Wales) (Amendment) (EU Exit) Regulations 2019

Amends will be made regarding cross referencing. Minor technical changes will be made.

The Environment (Amendment etc.) (EU Exit) Regulations 2019

Slight changed will be made effecting how the documents read. The following sections will be affected:

  • Contaminated Land (England) Regulations 2006
  • The Environmental Noise (England) Regulations 2006
  • The Environmental Damage (Prevention and Remediation) (England) Regulations 2015: Organisations with EMAS registrations or Ecolabels will need to re-register or re-apply.

The Flood and Water (Amendments) (England and Wales) (EU Exit) Regulations 2019 -Wales-

Slight changed will be made effecting how the documents read. The following sections will be affected:

  • Contaminated Land (Wales) Regulations 2006:
  • The Water Resources (Control of Pollution) (Silage, Slurry and Agriculture Fuel Oil) (Wales) Regulations 2010 – silo or slurry storage tank for use in a member State, Iceland, Liechtenstein, Norway or Turkey is removed as an option
  • Nitrate Pollution Prevention (Wales) Regulations 2013:
  • Private Water Supplies (Wales) Regulations 2017:

The Scottish Landfill Tax (Standard Rate and Lower Rate) Order 2019

Rates for Scottish landfill tax may change. This is charged by weight (per tonne).  

The Waste (Wales) (Miscellaneous Amendments) (EU Exit) Regulations 2019

Slight changed will be made effecting how the documents read. The following sections will be affected:

  • The Waste (Wales) Measure 2010;
  • The Landfill Allowance Scheme (Wales) Regulations 2005;
  • The Hazardous Waste (Wales) Regulations 2005;
  • The Recycling, Preparation for Re-use and Compositing Targets (Monitoring and Penalties) (Wales) Regulations 2011.

Amendments will be made to waste management legislation for them to be succinct. However, no substantial changes to the standards or policy will be made. The following points will contain changes in the Waste Framework Directive and Mining Waste directive.

  • The Waste (Wales) Measure 2010
  • The Landfill Allowances Scheme (Wales) Regulations 2004
  • Hazardous Waste (Wales) Regulations 2005
