September 2016 Legal Updates

This month we wanted to highlight a piece of legislation that came into force earlier this year. The Unauthorised Deposit of Waste (Fixed Penalties) Regulations 2016 amended Part 2 of the Environmental Protection Act 1990 to establish provisions for the unlawful disposal of waste. The change which came into force on 9th May 2016 allows local authorities to issue fixed penalty notices for fly-tipping of between £150 and £400. Providing this fine is paid within 14 days, no proceedings will be taken against the offender. However, if false or inaccurate details are given the offender is liable for a fine of up to £1000. Note this amendment just relates to small scale fly tipping incidents and applies to England only.
