Project 2 : Multi billion pound contractual construction dispute as a part of the £450m redevelopment of St Pancras Station, a Grade 1 listed building identified by English Heritage as the fourth most important heritage site in the United Kingdom, reviewing the performance of specialist contractors against Contract and Heritage requirements to verify compliance and the commercial impact of non-compliance.
Objectives
- To undertake a commercial review of subcontract packages on a £400m new-build station project.
- To undertake a commercial and contractual review of asbestos survey and removal activities at a Grade 1 listed railway station redevelopment programme.
- Provide commercial advice on the £500m Temple Mills train depot development
- Provide assistance to the appointed expert witness on Quantum during £20m adjudication
- To undertake a commercial review of subcontract packages on the Stratford International Station development project.
Approach and Deliverables
- Audit actual cost under the NEC standard form contract to determine amounts due under the Contract.
- Commercial cost audits of a number of subcontract packages on the Thames Tunnel section of the £5.5 billion Channel Tunnel Rail Link high speed rail development project.
- Responsible for various packages ranging from £150,000 to £20m.
- Responsible for undertaking a full take off of the steel package and auditing the associated costs.
Results and Business Benefit
- This dispute has the potential to change NEC law and the costruction industry as a whole.
- The dispute is between the project managers and the contractors on the Channel Tunnel Rail Link.
- Green Element is involved in the NEC contractual data and any environmental matters working on behalf of the Project Manager.
- Green Element is working very closely with the legal team.
- This dispute between two multi-billion pound joint venture consortiums on multimillion pound projects is a land mark case and is currently being debated with engineering circles.
